Accident with a FedEx Truck in Colorado

What Do I Do If I Was in an Accident with a FedEx Truck in Colorado?

If you are in an accident with a FedEx truck, try to remain calm and clear-headed. It will make everything that follows more manageable and less stressful. And if you are able, you should also call 911, gather evidence and information, stay off social media, and contact an attorney. Below we discuss these specific steps after an accident with a Fedex truck.

What to Do After an Accident with a FedEx Truck

While every situation is unique, you should follow four general tips after an accident with a FedEx truck.

Call 911

After an accident, you should immediately call 911, including when you are in a wreck with a FedEx truck. Depending on the accident’s severity and injuries, you may need emergency medical services or at least a law enforcement response. Paramedics can render aid, and police can help safely clear traffic, conduct an accident investigation, and later create a police report.

Even if you do not believe you are seriously injured, you should still be checked by paramedics and seen by a doctor to ensure the shock and adrenaline are not masking a severe injury.

Gather Information and Document the Scene

If you can do this safely, you should gather evidence at the scene. This includes speaking with witnesses, obtaining the FedEx driver’s information, making a mental note of any video surveillance, and taking photos.

You should take pictures and videos of the scene with your phone, including:

  • Photos of the damage to your vehicle and the FedEx truck;
  • Pictures of any injuries;
  • Video and photographs of the accident scene and vehicle placement;
  • Photos of skid marks on the road;
  • Other roadside damage (overturned poles, damaged signs, chipped curbs, etc.);
  • Photos of the street signs where the accident occurred; and
  • Photos of people involved in the accident and their injuries.

It is also wise to make a written note of what you can recall from just before, during, and after the accident (i.e., noting road conditions, weather conditions, where your car was located, etc.). This information can be helpful later.

Stay Off Social Media

This day in age, many of us are quick to post our day-to-day happenings on social media. However, one important but often overlooked tip following an accident with a FedEx driver is to stay off social media. You want to avoid posting pictures, videos, or status updates on your social media accounts. While it may seem harmless, doing so can be detrimental to the success of your case. Remember, FedEx has deep pockets, adept insurance adjusters, and competent counsel. That means that they will check your social media accounts for any evidence that weakens your claim. Even something you think is innocent can be used by them to suggest you are exaggerating your injuries. You must be careful what you post and share on social media if you are considering filing legal action following an accident with a FedEx truck.

Consult with a Colorado Accident Attorney

After a crash with a FedEx truck, you should consult a lawyer for guidance, advice, and legal representation. FedEx will defend claims against it diligently and strictly. They may offer you an insignificant amount early to settle your claim quickly and to save them money. You should only agree to this after speaking with your lawyer. Once you accept a lowball offer, you can never go back for more, regardless of how much more your injuries end up costing you. To be safe, do not speak with someone from FedEx, the insurance company, or anyone else—let your lawyer handle these communications.

Is FedEx Liable?

FedEx, like many delivery companies, hires both employees and independent contractors. What does this mean? Suppose the driver of the FedEx truck that hit you is a FedEx employee. In that case, FedEx will likely be liable for your injuries and damages, and FedEx insurance coverage will apply. However, it becomes more complex if the driver is an independent contractor. While FedEx may still be on the hook, naming the correct parties and proving liability and insurance coverage may be more challenging.

It is imperative to have a seasoned attorney who is familiar with these unique claims.

Safety Regulations Apply to FedEx Trucks

Like other commercial trucking and delivery companies, FedEx is required to comply with federal safety regulations. FedEx trucks and drivers must meet specific safety standards and protocols, including ensuring they comply with weight restrictions, competent hiring practices, and more. Our experienced truck accident attorneys are well-versed in federal and Colorado-specific regulations.
